By using the Community Development Homes website at communitydevelopmenthomes.com, its forms, or the Community Development Homes portal, you agree to these terms. If you do not agree, please do not use the site, its forms, or the portal.
This website describes Community Development Homes and the luxury residential development work it evaluates, underwrites, manages and governs in Arizona. The content is general information about the company and its activities. It is not legal, tax, accounting, brokerage, appraisal, financial or investment advice, and it is not a valuation of any property.
Architecture, interior design, landscape design, engineering and other professional services are performed by the appropriate professionals engaged for the project. Physical construction is performed by the appropriately licensed, separately operated construction company under the applicable agreements. Community Development Homes is not the builder, general contractor or construction contractor.
Nothing on this site is an offer to sell or a solicitation of an offer to buy any security or interest, and we do not accept capital or investment inquiries through the property intake form. Expressing interest through this website does not create any investment, funding or participation right.
You may submit a property or development opportunity, or send an inquiry, using the forms on this site. By submitting, you confirm that you are entitled to share the information you provide and that it is accurate to the best of your knowledge.
Submission does not create an agency, brokerage, confidentiality, exclusivity, compensation, partnership, financing or purchase obligation. Do not submit sensitive financial, tax, banking or identity information.
We review submissions at our discretion, may decline any submission, and are not obligated to respond, to pursue an opportunity, or to explain a decision. Any engagement, fee or compensation arrangement exists only if it is set out in a separate signed written agreement.
You keep ownership of the material you submit. By submitting it, you grant Community Development Homes a limited, nonexclusive, royalty-free permission for Community Development Homes and its service providers and professional advisers to use, store, copy and share that material solely to evaluate, verify, communicate about and administer the matter you submitted, and to keep our internal records of it. This permission does not transfer ownership of your material to Community Development Homes and does not permit public display or marketing use of it without your consent. You confirm that you are entitled to grant this permission for the material you submit.
Portal accounts may be provided to invited users, including investors, family office representatives, real estate professionals, capital sources, project participants, advisers, and other persons Community Development Homes authorizes for a particular matter or opportunity. Portal access is invitation-based or otherwise subject to Community Development Homes approval, may be limited to specific projects, matters, documents or functions, and does not create a right to access any other project or opportunity. We may suspend, restrict or revoke access at our discretion, subject to applicable agreements and law.
You are responsible for the accuracy of the account information you provide and for all activity that occurs under your account. You must keep your password and any other account credentials confidential, must not share them or allow anyone else to use your account, and must notify us promptly if you suspect that your credentials or your account have been compromised or used without authorization.
Materials on this website or in the portal may include underwriting, budgets, acquisition assumptions, development costs, comparable evidence, valuations or selling-value estimates, projected returns, timelines, financing assumptions, project risks, scenario analyses, and other preliminary or forward-looking information.
This information is prepared for evaluation and discussion. Estimates, projections and assumptions are not guarantees. Actual costs, timing, financing, approvals, market conditions, sale prices and returns may differ materially. Preliminary information may be revised, replaced or withdrawn. Unless a final project document expressly identifies it otherwise, material made available through the portal or this website is not binding investment terms.
Community Development Homes does not provide legal, tax, accounting or individualized investment advice through this website or the portal. Access to materials or discussions does not create an investment-advisory, fiduciary, agency, brokerage, partnership, joint-venture, financing or similar relationship between you and Community Development Homes. Evaluating suitability and making any investment decision remain your responsibility and that of your own advisers. Any actual investment relationship exists only through separate, executed project-specific agreements.
Any brokerage services provided separately by Peter Lupus through HomeSmart are outside these terms and are governed by their own separate brokerage agreements.
Preliminary and evaluative materials are provided as of their date, and Community Development Homes has no duty to update or correct them, except as required by applicable law or an executed project-specific agreement. Final rights and obligations are governed by the executed project-specific documents, not by preliminary material.
Non-public material made available to you through the portal is confidential unless expressly identified otherwise. You may use it only to evaluate or participate in the specific matter for which access was granted. You may share it only with people within your organization, or your professional advisers, who need it for that matter and who are subject to appropriate confidentiality obligations. You may not publish, redistribute, commercially reuse, or use it for any unrelated purpose without our written permission. Any more specific confidentiality provisions in separate project agreements continue to apply and control.
You agree that we may communicate with you, and deliver notices, documents and project materials, by email and through the portal. Subject to applicable law and any project-specific agreement, electronic delivery to the contact details on your account, or posting to the portal, satisfies delivery requirements. Please keep your contact details current.
Do not use this site to submit false, misleading or unlawful information, to attempt unauthorized access to accounts or non-public areas, to interfere with the site's operation or security controls, or to scrape or collect information from it by automated means.
The text, images, graphics and layout of this site belong to Community Development Homes or to the parties that licensed them to us, and may not be copied or reused without permission.
This site may link to pages operated by others, including listing, mapping and public records sources. We do not control those pages and are not responsible for their content or their handling of your information.
We work to keep this site accurate and available, but we do not guarantee that it will be uninterrupted, error-free or current. Information and figures shown here may change without notice. The site is provided on an as-is basis to the extent permitted by law.

You agree to indemnify, defend and hold harmless Community Development Homes and its owners, officers, personnel and service providers from and against claims, damages, losses, liabilities, costs and reasonable attorneys' fees arising out of or relating to your unlawful use of this site, material you submitted without the authority to submit it, false or misleading information you submitted, or your violation of these terms.
Information submitted through this site or handled through a portal account is treated as described in our Privacy Policy.
The following continue to apply after your account is suspended or closed, or you stop using this site: your responsibility for activity that occurred under your account, your confidentiality obligations for non-public portal material, the project, underwriting and investment information provisions, the no investment advice or fiduciary relationship provisions, the permission you granted for material you submitted, the content and imagery provisions, and the disclaimer, limitation of liability, indemnification, governing law and general provisions below.
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Subject to applicable law, the state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over any dispute arising out of or relating to these terms or this site, and you and Community Development Homes consent to that jurisdiction and venue.
If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce a provision is not a waiver of it, and any waiver must be in writing to be effective. You may not assign or transfer these terms or your account without our written consent; we may assign these terms in connection with a reorganization or transfer of our business. These terms, together with our Privacy Policy and the disclosures shown on our forms, are the entire agreement between you and Community Development Homes regarding this site, and they do not replace or limit any separate signed written agreement between us, which controls in the event of a conflict.
